Producer Licensing in the Age of AI Agents
The state-based producer licensing system was built for a world in which humans did the work. AI agents are now doing meaningful parts of that work. The licensing framework has not yet addressed what this means.
How producer licensing works today
Insurance producers are licensed at the state level. Every state requires individual producers to hold a resident or non-resident license for each line of authority they transact. A producer selling commercial property insurance in five states holds five licenses, or one resident license and four non-resident licenses. Each license is tied to a specific person, identified by a National Producer Number (NPN) maintained by the National Insurance Producer Registry (NIPR).
Licenses are issued to people, not to organizations. A producer entity (an agency or brokerage) may hold a separate business entity license, but the individuals who actually transact business are licensed individually. Appointments from carriers are made to the specific licensed individual, though in practice most carrier appointments flow to the agency and cover multiple licensed individuals within it.
The state licensing framework assumes that the licensed person is the one doing the work. When a producer issues a quote, prepares an application, binds a policy, or provides coverage advice, the licensing system assumes that a licensed human with specific training and examined competence is in the loop.
This assumption was reasonable when producers worked with paper forms, phone calls, and email. It is increasingly strained when producers work with AI tools that take meaningful actions in the workflow.
Where AI is actually doing the work
Several parts of the producer workflow are now commonly handled, in whole or in part, by AI tools:

Submission preparation. AI extracts data from prior ACORD forms, reviews loss runs, and produces structured submission packages for carriers.

Carrier matching. AI screens an account against carrier appetite statements and recommends target markets.

Quote comparison. AI parses quotes from multiple carriers and produces side-by-side comparisons.

Endorsement processing. AI drafts endorsement requests based on client communications.

Coverage review. AI reads policy language and flags gaps, conflicts, or non-standard terms.

Client communication. AI drafts explanatory notes, renewal summaries, and coverage recommendations for clients.
Some of these tasks are advisory; some are operational. All of them are within the scope of what a licensed producer is supposed to be doing. The question is whether, and under what conditions, it is acceptable for an AI tool to do them on the producer's behalf.
The licensing question in specific terms
The core licensing question is not abstract. It can be stated concretely: when an action taken in the producer workflow is initiated, completed, or substantively performed by an AI system rather than by the licensed producer, does the action satisfy the licensing requirement?
For some actions, the answer is reasonably clear. An AI that drafts a submission package does not need to be licensed, because the producer reviews and approves the submission before it is sent. The licensed human is meaningfully in the loop.
For other actions, the answer is less clear. An AI that automatically generates and sends a quote to a client, with the producer's general authorization but no specific review of the individual quote, is performing an act that in a traditional workflow would require a licensed human. Whether this satisfies state licensing requirements is, in most states, not clearly defined.
The hardest cases involve actions that happen at scale or speed. A producer who uses an AI agent to process hundreds of small commercial renewals per day is not reviewing each one personally. The agent is, in a practical sense, doing the work. The producer's license covers the overall operation, but the specific act of quoting, binding, or advising is happening without direct human involvement.

What state regulators have said
State regulatory guidance on this question is, as of late 2025, sparse and inconsistent. A few states have issued guidance specifically on AI use by producers, generally emphasizing that the licensed producer remains responsible for compliance regardless of the tools used. This is true but does not resolve the underlying question of what level of human involvement is required for a specific act to count as being performed by the licensed producer.
The NAIC Model Bulletin on AI use by insurers addresses carrier-level governance but does not directly address producer-level licensing questions. State-level producer licensing laws were written before modern AI tools existed and do not explicitly contemplate non-human actors in the workflow.
The practical result is that producers using AI tools are operating in a gray zone. They remain responsible for the outcomes, and most are proceeding cautiously, but the legal framework has not clearly defined where the line is between acceptable augmentation and unauthorized practice.
A framework for thinking about this
A useful way to think about AI involvement in the producer workflow is to categorize actions by the level of human involvement required.
Category 1: Pure data processing. Tasks that produce information for the producer to use but do not themselves constitute regulated acts. Document OCR, data extraction, market research, loss run summarization. AI tools in this category generally raise no licensing concerns.
Category 2: Preparation with human review. Tasks where the AI prepares output that the licensed producer reviews and approves before it is acted upon. Draft submissions, draft endorsement requests, draft client communications. If the producer reviews and approves, the act is attributable to the producer.
Category 3: Execution with human oversight. Tasks where the AI takes action on a stream of transactions under general producer authorization, with human review at the aggregate level rather than the individual transaction level. Automated quoting on standardized small commercial products, automated endorsement processing within defined parameters. This category is where the licensing question gets real.
Category 4: Autonomous action. Tasks where the AI takes action without meaningful human involvement at any level. This category exists primarily in hypothetical discussions rather than in practice, because no serious producer is operating without some level of oversight. But the boundary between Category 3 and Category 4 is not always crisp.
The licensing framework as it stands handles Category 1 and Category 2 acceptably. Category 3 is where the ambiguity sits. Category 4 is not yet a practical concern but is moving closer every year.
What regulators will likely require
Based on the direction of existing AI regulation in adjacent industries, a reasonable prediction for what state producer licensing will eventually require:
Explicit delegation documentation. When an AI tool takes actions under a producer's authority, the scope of that delegation should be documented. Not in a software vendor's terms of service, but in a record that is specific to the producer, specific to the permitted actions, and available to regulators on request.
Attribution at the transaction level. Each AI-initiated action should be attributable to a specific licensed producer, under a specific documented delegation. "The system did it under agency X's general account" is unlikely to be an acceptable answer in a regulatory review.
Disclosure to insureds. When an AI tool is materially involved in placing or servicing coverage, the insured should be informed. This follows the pattern already emerging in state AI disclosure requirements.
Competence verification. The licensed producer remains responsible for outcomes, which implies that the producer should have enough understanding of the AI tools being used to supervise their operation meaningfully. What "enough" means here is unsettled.
Action logging. AI-initiated actions should be logged in a form that can be reviewed by regulators, counterparties, or the producer's own E&O carrier. The logs should include what action was taken, under what authority, and with what outcome.
None of these requirements are radical departures from existing producer accountability. They are extensions of the same accountability framework to cover non-human actors operating under delegated authority.
What producers should do now
For producers actively using AI tools, the practical guidance is to get ahead of the regulatory direction. Specifically:

Document the delegation. Know which tools are taking which actions on your behalf, and document the scope of that delegation in writing. Do not rely on the software vendor's documentation.

Maintain an action log. Keep a record of AI-initiated actions that would be auditable if requested. Most AI tools produce some form of log; make sure you can access it and retain it.

Disclose appropriately. If an AI tool is materially involved in serving a client, let the client know. This is good practice independently of regulatory requirements.

Stay within appetite. Use AI for the kinds of standardized, lower-stakes decisions where oversight at the aggregate level is practical. Be more cautious about AI involvement in complex or high-stakes placements.

Understand what the tools are doing. Do not use AI tools that operate as black boxes. Be able to explain what actions the tool takes on your behalf and under what logic.
The producers who approach AI with this level of documentation will be in a much better position when the regulatory framework catches up, which it will.
What the industry needs
The individual producer steps above are necessary but not sufficient. The industry needs shared infrastructure to make AI-assisted licensing workable at scale.
Specifically, the industry needs a way for producers to issue structured, verifiable delegations to AI tools, and a way for carriers and regulators to verify those delegations independently. This is an infrastructure problem, not a product problem. No single AI vendor can solve it inside their own product, because the whole point is that the delegation needs to be trusted across tools and across parties.
Without shared delegation infrastructure, each AI tool will document its authority in its own way, each carrier will evaluate AI-initiated transactions with its own ad hoc policy, and each regulator will develop its own review framework. The result will be a compliance landscape that is more burdensome than it needs to be, without being more rigorous.
With shared infrastructure, producers can use AI tools with confidence that their delegation is documented in a regulator-ready form, carriers can accept AI-initiated transactions knowing the authority chain is verifiable, and regulators can focus oversight on actual problems rather than reconstructing delegation from vendor documentation.
Conclusion
The state-based producer licensing system is a decades-old framework being asked to handle a new kind of actor. The framework is not broken, but it is underspecified for the current reality. AI agents are already doing significant work in the producer workflow, and the licensing question of "what counts as the licensed producer performing the act" is not clearly answered.
The direction of regulation is toward explicit delegation, transaction-level attribution, and auditable action logs. Producers who build these practices now will be ahead of the regulatory curve. The industry as a whole needs shared infrastructure to make this practical at scale. Both the individual practices and the infrastructure are buildable. The question is how quickly, and in what shape.
